Six men, who were allegedly involved in a gang-rape of an underage girl were discharged of the case as a result of want of prosecution when they appeared recently in the St. Catherine Parish Court.
Charged with having sexual intercourse with a person under the age of 16 and grievous sexual assault was Dushaniel Henry; while Cody Richards, Howard Gayle, Shawn Ferguson and Leroy Thompson were charged with rape. The sixth accused, Christopher Desouza, was charged with being a holder encouraging the violation of child under 16.
The complainant, who was in a relationship with Henry was at the home of Desouza were they had sexual intercourse. It was alleged that the other young men, who are all friends, then partook and raped the complainant.
However, when they appeared before parish Judge Mrs. Grace Henry-McKenzie, the investigating officer told the court that neither the complainant nor her mother could be relocated. Numerous checks were made and to no avail.
The ruling was then made.
